The right to life and personal liberty implies the right to have the procedure for deprivation of such life and personal liberty according to law, and to be afforded like treatment as provided by law for bodies of that status. By reason of the constitutional morality, therefore, every one cannot be deprived of his life or personal liberty, except it is found that he has committed a cognizable offence, or is charged with such offence, or is accused of such offence, or is restrained of his freedom by the party responsible to society, acting in execution of any judgment, order or decree, passed in any case or special case, or falling within any of these three heads. No liberty can be granted, since liberty is a right and cannot be bartered for anything. By reason of the constitutional morality, therefore, no one can be deprived of his life or personal liberty even for a short period of time, unless it is found that he is committing an offence or is likely to commit an offence, or is likely to endanger the public morality, or unless it can be shown to be necessary or expedient in the interests of public safety or preservation of law and order, for the purpose of keeping the peace, protection of the public health or the public safety or prevention of activities prejudicial to public order, or for the purpose of bringing out an absconder from justice. In the ceremonial functions of the Republic, by reason of the constitutional morality, the life and personal liberty of the citizen cannot be taken away.
For the purpose of preserving public health and safety, therefore, Parliament may enact laws to regulate the sale and use of liquor, intoxicating liquors and drugs in a manner to protect the public health, safety, morals and general welfare.
The law-making power of the state can provide for the grant of licence to the industries, for the processing and sale of raw material, for the manipulation of articles of food for sale or consumption or otherwise for the grant of permit to carry out or engage in any business, occupation, trade or profession provided the restrictions imposed by the law are not arbitrary or unreasonable. d2c66b5586
